GENERAL TERMS AND CONDITIONS OF SALE

 

Tourism & City Tours, marketing the products “Bordeaux Visiotour”, “Bordeaux Authentic Tour” and “Duo Navette + Bassins des Lumières”, is a SAS with a capital of 5,000 euros, whose head office is located Z.A. Caroline Aigle – 7 rue Caroline Aigle – 33185 Le Haillan, registered in the Bordeaux Trade and Companies Register under the number 497 634 923 Professional liability insurance GAN ASSURANCES. The company Tourism & City Tours proposes on its website: www.bordeaux-citytours.com a ticketing service for the purchase of transport tickets for tourist visits of the city of Bordeaux and guided shuttles.

 

Article 1 – Definitions and scope of application

 

The present general conditions of sale apply to all transactions carried out via the present site: the users of the site must, prior to any purchase, have read and accepted them. The term “user” refers to any Internet user browsing the present site; the user who buys and pays for a service becomes a “client”. A service corresponds to a tour for a given day and time.

 

Article 2 – Purchasing procedure

 

The prices on this site are expressed in euros and are inclusive of VAT (10%). The user of the site must first choose the service he/she wishes to provide: the total price (depending on the total number and type of passengers) is displayed for the different tours available for sale. After accepting the present general conditions, the user proceeds to the payment by credit card through the secure payment system set up on the site.

After confirmation of the payment, the ticket order is only definitively confirmed and binding for TCT upon receipt of the email confirming that the order has been validated. Therefore, we invite you to check your e-mail. This confirmation email will contain the e-ticket(s) in PDF format as an attachment: it is up to the customer to print them on a printer (A4 format), or to present them in PDF format on his cell phone or tablet. Each passenger must present his or her e-ticket on board the “Bordeaux Visiotour”, the “Bordeaux Authentic Tour” or the “Navette Bassins des Lumières” in order to benefit from the services purchased. No other document will be accepted as proof of purchase (bank receipt, email, etc…). Each e-ticket contains the essential elements of the order: name and surname of the customer, date and time of the tour, type of passenger, ticket price.

As this is a transport service and moreover a tourist service, and in accordance with article L 121-20-4 of the French Consumer Code, the customer has no right of retraction.

Except in cases of fraud for which it is up to the user to provide proof, the user is financially responsible for his or her actions on the Site, in particular for the use that will be made of his or her e-mail address and password. He also guarantees the truthfulness and accuracy of the information provided on the Site.

Article 3 – Terms of payment

 

Online ticket orders must be paid exclusively by credit card and only in Euros. The cards accepted for this payment are the cards of the networks CARTE BLEUE, VISA, MASTERCARD.

 

Article 4 – Payment security and personal data

 

4.1 – Tourism & City Tours has entrusted the management of its payment system to its partner bank “Crédit Agricole”. Credit card information is encrypted using SSL (Secure Soket Layer) and is never transmitted in clear text over the network and is only kept during the processing of the order.

4.2 –The information and data concerning you are necessary for the management of your order and our commercial relations. This information and data is also kept for security purposes, to comply with legal and regulatory obligations and to enable us to improve and personalize the services we offer you and the information we send you.

In accordance with the French law of January 6, 1978, you have the right to access, rectify, and oppose any information concerning you. You can exercise this right by writing to Tourism & City Tours (Customer Service – Z.A. Caroline Aigle – 7 rue Caroline Aigle – 33185 Le Haillan – France), indicating your name, first name, address and, if possible, your customer reference. In accordance with the regulations in force, your letter must be signed and accompanied by a photocopy of an identity document bearing your signature and specify the address to which the reply should be sent. A reply will be sent to you within 2 months of receipt of the request.

 

Article 5 – Access on board

 

Access to the “Bordeaux Visiotour”, the “Bordeaux Authentic Tour” or the “Navette Bassins des Lumières” will be exclusively on presentation of the e-ticket sent via the present site and printed on an A4 sheet or readable in PDF format on a smartphone or tablet. An ID or any other proof of identity may be requested to check the granting of a discount. No child under 12 years of age will be accepted on board without being accompanied by an adult, even if he/she is in possession of a paying ticket.

E-tickets must be kept for the duration of the tour and presented to Tourism & City Tours staff when boarding the bus or at their request

Article 6 – Cancellation / Refund

E-tickets are neither exchangeable nor refundable. Tourism & City Tours is not responsible for lost or stolen tickets. E-tickets cannot be transferred or resold. Any fraudulent use of e-tickets, as determined by a TCT agent, will result in immediate and permanent exclusion from the service, without prejudice to possible legal action.

In case of cancellation of the service by the customer himself, or interruption during the tour at the initiative of the customer, no refund will be made. Tourism & City Tours draws the attention of its customers to the fact that no cancellation insurance is included in the proposed rates.

Should Tourism & City Tours have to modify or cancel one or more tours for reasons beyond its control, Tourism & City Tours will, in agreement with the customer, postpone the initial booking to another tour or, if this is not possible, refund the full amount of the tour. It will be the same if the number of passengers, 8 people minimum, was not reached to ensure the departure. No compensation can be claimed in addition by the customer.

Article 7 – Schedules, duration and circuit

 

TCT reserves the right to modify without notice the time and duration of the visits as well as all or part of the tour in case of force majeure or events beyond its control (traffic jams, detour, road works, accidents, demonstrations, weather conditions and other events likely to disrupt the visit).

 

Article 8 – Damage

 

Passengers are responsible for any damage to the vehicle caused by them. In this case, the customer commits himself to reimburse the expenses of restoration on presentation of invoices.

 

Article 9 – Loss or theft

 

TCT is not responsible for damage, loss or theft of anything left on the bus during or after the trip. TCT cannot guarantee the return of items left on board the vehicles.

 

Article 10 – Intellectual Property

 

Tourism & City Tours is the owner of all rights relating to intellectual property for all elements on the site. You may not reproduce, modify, transfer, or exploit any part of this site without the express written permission of Tourism & City Tours. However, partial reproduction for strictly private purposes is permitted. It is forbidden to resell products or to use the site for commercial purposes without the express written permission of Tourism & City Tours.

 

Article 11 – Applicable law

 

The applicable law for the transactions carried out via the site www.bordeaux-citytours.com is the French law. Any dispute arising from a transaction carried out via this site will be dealt with by the Court of Bordeaux.

 

Special conditions

 

  • A seat on the floor (Visiotour bus) cannot be guaranteed if the customer arrives less than 20 minutes before the start of the tour,
  • TCT reserves the right to refuse access to the bus to anyone who behaves inappropriately,
  • TCT may require a passenger to leave the bus if his or her behavior is offensive, embarrassing or constitutes a danger to the safety of our driver, others or to his or her own safety, without engaging TCT’s responsibility.

 

FOR YOUR SAFETY

 

  • Seat belts must be worn by all passengers in vehicles equipped with them.
  • Beware of branches, traffic lights and anything else near the vehicle.

 

  • It is strictly forbidden:

– standing, moving around, using the stairs or talking to the driver while the bus is in motion,

– leaning over the railings,

– smoking, eating and consuming alcohol on board the vehicles.
